    TWU has been informed by American that they plan to resume USPS drug tests on Fleet Service Clerks. While the vast majority of Fleet Service Clerks records reflect they were drug tested, some members’ records hired after 1998 do not, according to the Company, and they need to comply in order
    to meet Postal Service requirements.

    TWU has filed a lawsuit as we attempt to stop this drug testing, since the testing disregards the collective bargaining agreement and American’s own drug testing policy. TWU filed a motion for expedited injunctive relief earlier this week, but the court has not as yet set a schedule for that motion. While TWU is contesting American’s actions, the issue remains unresolved. As such, Fleet Service Clerks should be prepared for the possibility that they may be directed to submit to this USPS drug test. Be advised that members should avoid creating a situation where they would be subject to discipline by refusing to respond to the Company’s request, while the Union works toward a resolution of this problem.
